Timex and water resistant watches

I received a new timex watch for Jesusmas this year.
Here is a part of the instructions:
Note item 2: Watch is not a diver watch and should
not be used for diving.
I think this is a great warning. HOWEVER, the instructions say water resistant to 328 feet. Suppose I am 328 feet underwater and NOT diving. What am I doing there? Maybe this watch was only made for Aqua-man.
Oh wait! you say. The rating doesn't mean you can go down to 328 feet, it just means that it is splash proof. Well, if that is the case then why give a depth at all. This is crazy. I have used timex watches like this before AND for diving. I have never had a problem.
(actually, the only sense I can make of this is that you should not use this watch as a time keeping device that your life depends on but it won't break either).
